Transitional Justice

How do societies deal with past atrocities associated with dictatorship, war or genocide? Should such efforts focus on individual guilt or collective reconciliation, and who are to decide on the right policy, the international community or the local survivors? Can justice mechanisms help to end wars or may they undermine a fragile peace? Transitional justice is a conception of justice associated with periods of political change, often from dictatorship to democracy or from war to peace.

 

The course analyses a variety of transitional justice mechanisms, from amnesties and restorative rituals to truth commissions and formal trials, by situating them in their historical and normative context and assessing their empirical expressions. As such, the course will engage critically with the paradigms, developments and major debates concerning justice while examining their articulation in particular cases.
