Course aim
This course addresses the historical development of international investment law, focusing particularly on the origins, policy objectives and evolution of the law governing foreign investments. It focuses in detail on the scope of application of international investment treaties, including BITs, FTAs, and other multilateral regimes such as the Energy Charter Treaty (ECT).The course also tackles the principle of non-discrimination on the grounds of nationality, which is enshrined in many international investment treaties (e.g., BITs, FTAs, and the ECT). A particular focus will be placed on the obligation to grant national treatment (NT) and most-favoured-nation (MFN) treatment.
